1. Quotations
Quotations are valid for 30 days from the date of issue unless stated otherwise. Prices are quoted per piece and exclude freight, insurance and any destination duties unless the quotation expressly states CIF or DDP terms. Tooling, plate and screen charges are quoted separately and are not included in the unit price.
2. Orders and specification
An order is accepted when we issue a Proforma Invoice and receive the agreed deposit. Production runs to the specification approved in the signed-off sample. Once a sample is approved and tooling is released, changes to capacity, glass colour, neck finish or decoration may require new tooling and will be re-quoted.
3. Tolerances
Glass is a manufactured material and is supplied to industry-standard dimensional and weight tolerances. Capacity tolerances, wall thickness variation and colour variation within an agreed range are not defects. We will state the applicable tolerances in the specification sheet before production.
4. Payment
Standard terms are 30% deposit by T/T with the balance against the bill of lading, or an irrevocable L/C at sight. Any bank charges outside China are for the buyer's account. Where open account terms are agreed, payment is due as stated on the invoice.
5. Delivery and risk
Delivery dates are estimates given in good faith and run from the later of deposit receipt and sample approval. Risk passes according to the agreed Incoterm. Where we arrange carriage, we do so as the buyer's agent and are not liable for delay caused by carriers, ports, customs or force majeure.
6. Inspection and claims
Claims for shortage or visible damage must be notified within 14 days of arrival and supported by photographs, packing list references and, where requested, an independent survey. Our liability is limited to replacement of defective goods or a credit note at our option, and does not extend to consequential loss, lost profit or recall costs.
7. Intellectual property
Buyer-supplied artwork, moulds and designs remain the buyer's property. We will not use a buyer's bespoke mould or artwork for any other customer. Moulds paid for by the buyer are retained on our site for the buyer's exclusive use for a period of 24 months from the last order, after which storage and disposal terms may be agreed.
8. Governing law
These terms are governed by the laws of the People's Republic of China. Disputes are subject to the jurisdiction of the competent court in Xuzhou, Jiangsu, without prejudice to any arbitration clause agreed in writing.
